"Travelling from Delhi to Ghaziabad would not cause hardship": Supreme Court refuses to transfer case

"I do not think travelling from Delhi to Ghaziabad for defending her case would cause great hardship to the petitioner", remarked Justice Aniruddha Bose while refusing to transfer a case.

The petitioner-wife had approached the Supreme Court seeking transfer of a case filed for restitution of conjugal rights instituted by the respondent-husband.

It was thus sought that the case be transferred from the Court of Principal Judge, Family Court, Ghaziabad, U.P. to Family Court, Karkardooma Court, Delhi.

AOR Sunil Kumar Verma, appearing for the petitioner submitted that there was threat to the life of his client in travelling to Ghaziabad.

To this Justice Bose said,

"If that is the case, the petitioner ought to approach the Court where the matter is pending for appropriate protection measure from the police."

The Top Court went on to dispose of the transfer petition saying:

"Considering the short distance between the locations of these two Courts, I decline to entertain this transfer petition. I do not think travelling from Delhi to Ghaziabad for defending her case would cause great hardship to the petitioner."
