Supreme Court seeks Center's response on non appointment of TDSAT member irrespective of SCSC's recommendation

The Supreme Court has sought response from the Central Government in an application moved over non-appointment as a member of the Telecom Dispute Settlement Appellate Tribunal even after the recommendation of the Search Cum Selection Committee headed by Justice L Nageswara Rao.

A bench of Justice DY Chandrachud, Justice Surya Kant and Justice Bela M Trivedi sought an explanation over the non-appointment of the applicant stating, "The relevant files may be produced before the court before the next date of listing."

The instant Intervention Application has been moved by one AM Alankamony over his non-appointment alleging that his name has been recommended for the appointment as TDSAT Member by the SCSC Committee headed by Justice L Nageswara Rao.

Attorney General KK Venugopal, however, apprised the bench that the appointment is pending with the Appointments Committee of the Cabinet after the same having been recommended by Justice Rao after he met with the members in furtherance to the vacancy notified in November 2021.

Senior Advocate Vikas Singh appeared for the applicant. The bench has listed the matter for May 11, 2022 for further hearing.
