Supreme Court asks Advocate Mehmood Pracha to consider writing 'unconditional apology' to Central Administrative Tribunal

The Supreme Court has today asked Advocate Mehmood Pracha to consider writing an unconditional apology to the Central Administrative Tribunal in a matter where CAT found Pracha guilty of Contempt of Court.

A bench of Justice KM Joseph and Justice S Ravindra Bhat said, "What we were tentatively considering, with regards to whatever happened. We will consider setting aside the order, if an unconditional apology is written to the tribunal. He is a lawyer, this would balance it out."

The plea has been filed by Advocate Mehmood Pracha challenging the order of the Central Administrative Tribunal which had found him guilty of Contempt of Court, however, let him off with a severe warning.

Pracha while arguing for himself said, "Milords I'm not sitting here to apologize for something I have not committed."

Whereas, the bench adding up to its suggestion said, "We all commit mistakes, at the end the idea is to sum it up. Think about it, don't throw it out without contemplation, otherwise we know what we have to do, where it'll reach we don't know. Don't jump to a conclusion right now."

However, Pracha further contended, "Since then I'm thinking about it that what wrong have I done, I was only defending the honor of this Court, that please don't say these things in an open court.

"I only said that if the court has to say all these things, then please say it in an in-chamber hearing," Pracha added.

The bench while allowing Pracha some time to think has posted the matter for hearing after a month.

The statement of CAT over the issue said, "Though repeated requests were made to advance arguments did not appeal to him. He started humiliating the other side counsel by saying that they have no right whatever to plead before the Tribunal as per the orders of the Supreme Court."

"Seeing that his provocation is not yielding the expected results, the respondent herein went on making personal attack on the chairman," the statement added.
