SIT that gave clean chit to Narendra Modi should be itself investigated: Kapil Sibal tells Supreme court in Gujarat riots matter

While arguing on behalf of Zakia Jafri in the Gujarat riots matter, Senior Advocate Kapil Sibal today told the Supreme Court that the Special Investigation Team which gave a clean chit to then Chief Minister of Gujarat, Narendra Modi, in the 2002 communal riots case should itself be investigated for rendering conclusions contrary to facts.

Sibal, who was representing Zakia Jafri, widow of slain Congress MP Ehsan Jafri further told the Court that the SIT did not conduct an investigation' but did a 'collaborative exercise' and its probe was full of omissions in order to protect the conspirators.

A bench of Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar were further informed that evidence in the form of electronic records including call data records of senior police officials and mobs identifying houses of Muslims, was ignored by the SIT.

He added that while the investigating team did not take the investigation any further, the Magistrate as well as the High Court chose to overlook the evidence.

During the hearing, Jafri went on to submit that all the officials who were involved in the investigation were rewarded.

Sibal also told the Court that there were statements by people belonging to Vishwa Hindu Parishad and Rashtria Swayamsevak Sangh claiming that public prosecutors were acting at their behest.
