Shiv Sena leader Kishore Tiwari seeks Supreme Court's intervention in NCB's investigation

A letter petition filed in the Supreme Court  has sought the intervention of the Supreme Court and take suo moto cognizance to protect the fundamental Human Rights of Mr. Aryan Shahrukh Khan.

The plea filed by Shiv Sena leader Kishore Tiwari alleging that "There is utter disregard to the principles of Right to Life & personal liberty as law settled by this Court apart from a classic example of abuse of powers by one NCB officer who seems to be on vendetta against Film industry to take revenge due denial entry to his wife who is model & celebrity."

The plea stated that NCB at Mumbai and its officials are targeting select film celebrities & few models for the last two years as NCB official whose wife at Mumbai is also a film celebrity, having a direct competition with the models & film celebrities against whom her husband NCB officer is taking action under NDPS Act in most malafide manner.

The plea has further sought judicial inquiry and investigation into the malafide role & vendetta style of working of NCB officer whose wife is in competition with other film celebrity/ model against whom NDPS Act action taken by this biased NCB officer.

Tiwari through his petition states that "NCB under NDPS Act is abusing position and trying to deprive the basic Human Rights of the person accused under NDPS Act and by misconstruing the provisions of the law, the poor, innocent people are being put behind the bars."

The petitioner has relied upon the Judgment pronounced by a bench headed by Justice L Nageswara Rao stating that "The right of an accused, an undertrial prisoner or a convicted person awaiting appeal court’s verdict to seek bail on suspension of sentence is recognized in Sections 439, 438 and 389 of the Code of Criminal Procedure is an inherent right."

Earlier, A Mumbai Court has rejected the bail pleas of Aryan Khan, son of Bollywood actor Shahrukh Khan, actor Arbaaz Merchant, model Munmun Dhamecha in the Cordelia Cruise Drugs case held.

Later, Additional Sessions Judge VV Patil while hearing the bail plea of Aryan Khan had directed all parties to file their replies in the case by October 20.

Bollywood superstar Sharukh Khan’s son, Aryan Khan, and seven other accused were arrested after the NCB raided their alleged drug party aboard the Cordelia Cruises ship on October 3, these arrests sent shock waves among the general masses and the people in the entertainment industry alike.
