[Namaz in open spaces] Haryana resident moves Supreme Court opposing plea that alleged inaction by officials in curbing communal & violent tendencies

A permanent resident of Haryana has moved the Supreme Court opposing former Rajya Sabha member Mohammed Adeeb's plea alleging inaction by Haryana's top officials in curbing communal and violent tendencies. 

In December 2021, Adeeb had approached the top court in light of the recent row over Friday prayers being offered in open spaces at Gurugram. 

Adeeb had stated that in being unable to curb elements who are protesting at the sites, the Haryana officials stand in contempt of the Supreme Court's directions in Tehseen Poonawalla Vs. Union of India.

The petition stated that in light of the the Poonawalla judgment, certain directions and measures are required to be taken by the authorities to "curb the communal and violent tendencies that result in perpetration of hate crimes".

The IA filed by one Surjit Singh Yadav seeks that Adeeb be directed to refrain from offering namaz on public property in the district of Gurugram, Haryana.

Yadav, who is the Vice-President of an NGO named Hindu Sena has further submitted that to encroach the public land, for offering namaz prayer in large number by the members of Muslim community, is itself in violation of the Poonawalla judgment.

The application further submits that Adeeb is indulging in the act of riot provocation which is evident from registration of FIR against him for forcibly encroaching upon a land in Sector 40 Gurugram for construction of a mosque.

Having experienced that assembly of a large number of people at one place to show religious supremacy may create a situation of aw
and order problems, the applicant has submitted that the Petitioner and his associates must impose upon themselves self-restraint
from encroaching public land or public property for offering namaz.

" ...most of the riots in India have taken place in the afternoon of the Friday. It is because on Friday Namaz, large number of members of Muslim community gather on a particular place and after Namaz prayer is over, hate speeches are given by the Imam against followers of other religions and such speeches motivate the members of the assembly to commit mob violence on the members of the other religious community....." adds the application.
