The Anti-Money laundering act will lose its value if Enforcement Directorate used beyond contours, Supreme Court

The Supreme Court on Wednesday said that indiscriminate use of Enforcement Directorate will affect the value of Prevention of Money Laundering Act (PMLA).

A bench of the Chief Justice of India NV Ramana, Justice AS Bopanna and Justice Hima Kohli was hearing a plea filed by Usha Martini Ltd challenging order of the Jharkhand High Court for allegedly exporting Iron Ore Fines.

The Supreme Court has today issued notice while staying any coercive action against the petitioner.

Justice Bopanna said that "if you use ED proceedings indiscriminately then the Act loses its value."

The plea has said that the proceedings has been initiated on the premise that the petitioner violated the lease agreement with the Jharkhand Government while indulging in export of Iron Ore Fines.

Earlier, the High Court had dismissed the plea filed by the Usha Martini Ltd. against the summons issued by in relation to the criminal proceedings initiated for offences under PMLA Act by the District Session Judge Cum Special Judge, CBI.
