The Supreme Court has today disposed of an application seeking direction to conduct a backup examination for the July attempt of the CA 2021 examination before November 2021.
A bench of Justice AM Khanwilkar, Justice Hrishikesh Roy, and Justice CT Ravikumar said to ICAI, "We are not disturbing your cycle but make sure after November, one more examination will be there on the old syllabus for the opt-out students"
Advocate Prashant Bhushan appearing for the petitioner submitted that earlier a direction has been made that a Backup examination should be allowed to the candidates who were unable to attend the examination, however, what has now been done is that the students can take the examination when the next regular examination comes up i.e. in November 2021.
It was alleged by Bhushan that these people will lose an attempt while seeking that ICAI should be directed to hold a backup examination.
However, Senior Advocate Ramji Srinivasan contended that there will be no loss of opportunity. "It will not be treated as an attempt at all, all benefits that were supposed to be given will be there, Srinivasan added.
Bhushan further raised the issue relating to the seniority of the candidates as the year in which the students pass the examination the seniority is counted from that year itself.
However, the bench said that the petitioners can file a representation before the institution in this regard.
The bench disposed of the writ petition on the assures given by Srinivasan and further directed ICAI to consider the representation filed by the petitioners within 2 weeks from the date of receipt.
