The State of West Bengal has alleged non-cooperation of Central Industrial Security Force (CISF) in the investigation of Sitalkuchi firing in Bengal where five people lost their lives.
During the fourth phase of assembly elections in West Bengal on April 10, 2021, a total of five people were killed in Sitalkuchi in Cooch Behar. Allegedly, four of them were killed in Central Industrial Security Force (CISF) firing.
In Monday's hearing Adv. Bikash Ranjan Bhattacharya representing the petitioner stated that the report filed by the state is incomplete, to which the state submitted that CISF is not cooperating in the said investigation.
Further, advocate representing the Union of India raised a preliminary objection on grounds of maintainability. The counsel stated there is a distance of around 600 km between the place of residence of the petitioner and the place of Incident. The counsel claimed that the petitioner claim one "can not affirm something true to knowledge when one don’t have any knowledge." The Counsel thus claimed for dismissal on the same ground.
The High Court Bench of Chief Justice Prakash Srivastava and Justice Rajesh Bharadwaj permitted the Union to raise objection about maintainability in opposition. The Petitioner has been allowed to file exception to report of the Union.
