Spinal injury during alleged custodial torture and illegal detention; Delhi High Court seeks status report from Delhi Police

The Delhi High Court has sought status report from the Delhi Police on the steps taken against erring officers in view of the vigilance report in a matter where a person suffered spinal injury during alleged illegal detention and custodial torture.

A bench of Justice Jasmeet Singh issued notice observing that the Delhi Police itself in its vigilance report found that the allegations were true. 

The petition was filed by Waseem Khan who suffered spinal injuries during the alleged illegal detention and custodial torture seeking registration of an FIR and demanding investigation against erring police officials named in the vigilance inquiry report and their dismissal from the service. 

Advocate Harsimran Duggal appearing for the petitioner submitted that in view of the expert opinion by the medical board, statement of complainant/victim and witnesses, submissions of alleged police officials regarding his fit condition at the time of walking out of police station after handing over him to his maternal uncle by local police cannot be entertained, hence, allegations made in the complaint against all alleged police officials namely SI Satyender Gulia, HC Jitender, and CT Praveen Kumar are proved.

The plea had submitted that the petitioner is only 31 years old and is now suffering from a serious spinal injury that will persist lifelong. The plea had further sought compensation from the Central Government in view of the alleged incident.

The bench has directed the Additional Public Prosecutor to submit a status report on the steps taken by the Delhi Police against the erring officers in view of the vigilance report.
