Karnataka High Court directs Tehsildar to clear encroachments on land allowed to Ex-servicemen

A Karnataka High Court bench of Chief Justice Rituraj Awasthi and Justice Sachin Magdum came to the aid ex-servicemen by directing the Tehsildar of Doddabalapur Taluk to clear the encroachments on land allotted to them by the government and give them the possession of the same in 4 months.

The counsel for the petitioners submitted that the ex-servicemen had served as a subedar. It was submitted that after retiring from service they sought for allotment of land under ex-servicemen quota, they were duly allotted the land by an order dated 2003.

It was submitted that despited the grant being in their favour, the authorities have not delivered possession. The petitioners thus approached the court seeking the court to direct the authorities to grant possession of their lands.

When the writ petition came up before the single judge, he was of the view that there is a dispute in regard to availability of land therefore ordered an enquiry.

The Tehsildar held the enquiry and subsequently prepared a report . The court in its order noted that the report suggested that there are several unauthorised occupants, despite the ex-servicemen being granted 5 acres of land each.

The court held that  authorities are bound to give effect to it and deliver possession in terms of grant given to the ex-servicemen in 2003. The court further held that It would be open for the Tehsildar to take appropriate actions swiftly, therefore proceed to decide claim, and deliver the possession to the ex-servicemen within a period of 4 months.
