The Supreme Court on Wednesday stayed the Haryana Judiciary (Mains) examination scheduled for May 6 to 8, 2022 as it was clashing with the date already fixed by the High Court of Madhya Pradesh for the Preliminary Examination of the Madhya Pradesh Judicial Services.
A bench of Justice Vineet Saran and Justice JK Maheshwari as an interim measure has stayed the examination. The matter has now been listed for May 9, 2022, directing the High Court of Punjab and Haryana to either assist the Court in deciding a suitable date or to reschedule the examination for a different date.
A plea was filed challenging the notification issued by the Haryana Public Service Commission whereby the Mains Examination of the Haryana Civil Services (Judicial Branch) had been fixed to be conducted from May 6 to May 8 alleging that the date May 6 is clashing with the dates already fixed by the High Court of Madhya Pradesh for preliminary examination of the Madhya Pradesh Judicial Services.
The plea stated that the petitioners are likely to be prejudiced and their right to participate in the Madhya Pradesh Judicial Services will be infringed and an irreparable loss and injustice will be caused to the petitioners if the dates of the Mains Exam of Haryana Civil Services (Judicial Branch) is not changed and fixed on other dates not clashing with any other judicial exam.
The plea sought direction to quash the notification and to postpone the Mains Exam of Haryana Civil Services (Judicial Branch) to any other date except May 15, 2022, as it is the date of preliminary examination of Gujarat Judicial Services.
The matter was mentioned by a Counsel last Friday stating, "Thousand of aspirants will be debarred, Milords". Whereas, a bench of the Chief Justice of India NV Ramana, Justice Surya Kant, and Justice Hima Kohli had asked the petitioners whether the court can fix and change dates of examinations. However, the bench had said that the matter will be listed next week.
