Dalit Positive Movement, a Kanpur-based Dalit rights organization has lodged a complaint with the Commissioner of Mumbai Police, Ministry of Home Affairs & the National Commission for Scheduled Castes (NCSC) against Nationalist Congress Party MLA Nawab Malik as per the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
The organization has sought for the lodging of an FIR and Malik's arrest within 24 hours. “If an FIR is not registered within the next 24 hours then we will approach the District Magistrate court for the same,” the organisation states.
The complainants have alleged that Malik has "malafide intent and vitriolic, casteist contempt towards Mr. Sameer Wankhede" and is misusing his constitutional power to attack the officer.
The complaint states that the Maharashtra Minister is "publicly shaming a decorated officer just because he belongs to the Dalit community".
Stating that Malik is atrociously threatening, intimidating, insulting, and mocking an honest NCB officer, the complaint has been lodged on the grounds including “obstruction of Justice, misuse & abuse of power to threaten & intimidate the NCB officer belonging to SC/ST community.”
The organization has alleged that Malik is misusing his constitutional position to insult and vilify an honest officer, thereby becoming a dangerous threat to other constitutional institutions of our Democracy.
Further, the complainant group has also demanded a comprehensive security for Sameer Wankhede and his family stating that there seems to be a credible threat to his life and the lives of his family members and his subordinates.
Pointing out that there have been many youths caught, charged and many even punished as per law for substance abuse but such an organized support in favour of the accused has never been seen before,the organization has further alleged,
"We suspect a larger conspiracy between the Durg Mafia and Terrorist Organizations in collusion with certain political elements in the incumbent Maharashtra government to disrupt, derail, deflect and divert the ongoing investigations in the Aryan Khan drug case."
Wankhede is currently working as Zonal Director of the Narcotics Control Bureau (NCB) in Mumbai and probing the high-profile drug seizure Cruise Ship Drugs Case.
Nawab Malik has alleged that Wankhede had extorted money from Bollywood when an independent witness Prabhakhar Sail mysteriously alleged that Rs 25 crore was demanded on behalf of the officer to let off the accused Aryan Khan.
On Monday, the NCP MLA had also shared images of what he claimed were Wankhede's Nikahnama and birth certificate, alleging that Wahkhede had forged documents to obtain his job as a Scheduled Caste candidate. Malik claimed that Wankhede was a Muslim by birth and his real name was "Sameer Dawood Wankhede".
The organization alleges that Nawab Malik has launched a mindless hate campaign against Wankhede raising unreasonable questions on his integrity, work ethics, and has made allegations based on hearsay against an honest officer for doing his job.
The complaint reads that Malik jumped to conclude that Mr. Wankhede had forged documents but did not produce even a shred of legally admissible evidence against his concocted allegations.
"These are highly contemptuous allegations and a targeted attack against an honest officer belonging to the lower strata of our community," it adds.
As per media reports, Wankhede has rubbished these vicious allegations leveled against him and has also lodged a complaint with the state police and Union government for being stalked regularly when he visits his mother’s grave who passed away in 2015.
Backing up the actions taken by Wankhede during last two years of investigation that amounts to seizure drugs worth Rs 17,000 crore, the organization contends that instead of lauding him for not letting these dangerous substances come on the streets of our country to poison our youth, there is a concerted effort to vilify him and derail the investigations, simply because it is against a celebrity's son and the investigation is being conducted by an officer belonging to the SC/ST community.
Reportedly, another complaint has also been filed before the Mumbai Police by a Malad-based woman stating that that it was quite shocking and concerning the way "an incumbent Maharashtra minister is publicly influencing and defending the drug cartel and those accused in the drug case."
As per media reports, Sameer Wankhede’s sister, Yasmeen Wankhede has also lodged a complaint against the NCP leader. She has also mailed a copy of her complaint to the National Commission for Women (NCW).
Yasmeen has alleged that the NCP leader was stalking her and had shared her pictures of her Maldives trip on social media without permission.
