Bengal state Bharathiya Janata Party members have reportedly moved Supreme Court against the division bench order of the Calcutta High Court which rejected its plea to deploy central forces during upcoming civic polls.
Yesterday, a Calcutta High Court bench of Chief Justice Prakash Shrivastava and Justice Rajarshi Bhardwaj had rejected the appeal moved by the BJP against a Single Bench order which had denied its plea to deploy central forces.
BJP had pleaded before the division bench that the appeal stemmed from apprehension that post-poll violence that happened in May this year after assembly election might happen again.
On Thursday, Justice Rajsekhar Mantha had quashed the petition, and had ordered the Commissioner of Police to attend to any further complaints lodged and take appropriate measures to safeguard the right of citizens to exercise their franchise.
It was then contended by BJP that Justice Mantha had decided their plea under the misconception that four party members had approached the Court, whereas the fact of the matter is that the party itself is presenting the plea.
The said elections are to be held tomorrow, i.e., December 19.
Earlier, the Supreme Court had declined to hear the plea while stating that,
"We cannot take decisions with respect to the requirement of Central force. The High Court will be in a better position to know the situation."
