Delhi Court rejected application seeking extension of Police custody of Sushil Kumar, accused of serious criminal charges against a junior wrestler, Sagar Rana.
Duty MM Rashmi Gupta, while rejecting the extension of custody, observed,
“… As per settled law PC remand should not be granted in a mechanical manner. It should be granted only when the situation so warrants and it is justified. Through the present application, the applicant prays for further PC remand of three days. PC remand of 10 days of the accused person has already been granted… remand of six days was granted by Ld. Duty MM vide order dated 23.05.2021 and further PC remand of four days was granted vide order of Ld. Duty MM dated 29.05.2021.”
Additional PP, Atul Shrivastava appeared for the State.
Advocate Pradeep Rana appeared for accused.
Sushil Kumar and his co-accused Ajay Kumar, a physical education teacher at Chhatrasal Stadium were arrested by Delhi Police from Mundka Area.
On the previous date of hearing, Duty MM Mayank Goel, while granting an extension of four days to the Police, noted, “Though Constitution guarantees the Right to life and liberty to all persons whether they are accused or not but that right is subject to certain exceptions. The Court is duty bound to strike a balance between the fairness of investigation and the rights of the accused.”
On May 18, ASJ Jagdish Kumar, rejected anticipatory bail application of Sushil Kumar, noting that charges were of a serious nature and the FIR revealed a prima facie case against the accused.
It is alleged that wrestler Sushil Kumar engaged in an argument, followed by an armed fight with the deceased on the intervening night of May 4 and May 5, 2021.
While Sagar Rana succumbed to death on May 5, his friends sustained grave injuries.
Delhi Police issued a look out circular against the accused on May 10 and had announced a reward of Rs 1 lakh on any information related to his whereabouts.
On May 15, NBWs were issued against the accused and nine others related to the present matter.
