"Nothing survives in the plea": Delhi High Court says after woman claiming threats from UP Government officials upon conversion to Islam fails to deduce evidence

"There is no question of any official issuing threats to woman who converted to Islam with her own free will," the Uttar Pradesh Government has informed Delhi High Court in plea by a woman who claims that she has been receiving threats from the Government of Uttar Pradesh because she converted Islam on her own volition.

After hearing submissions by the Respondent(s) including State of Uttar Pradesh and on behalf of GNCTD according to which the Petitioner woman had not shared any details of the threats nor produced any evidence to suggest the same, Justice Rekha Palli stated that in her view nothing survived for adjudication in the present petition. However, the bench proceeded to adjourn the case till 10th November, 2021 on account of non availability of the main counsel.

The petitioner claims that she has been receiving threats from unknown persons after she had converted to Islam of her own will and volition and has approached the Court seeking police protection. It is the petitioner’s case that she has received some of these threats from officials of the Government of Uttar Pradesh.

Garima Prashad, Additional Advocate General of the State of Uttar Pradesh contended that there is no question of any official of issuing any threats to the petitioner. "She has neither provided any details of any threat received by her, nor has she provided her mobile number or latest address to the said respondents," she said.

She further submitted that the petitioner had failed to provide any details of the purported threats received by her, praying that that the writ petition be dismissed.

Sameer Vashisht, Additional Standing Counsel for GNCTD informed the Court that the woman had neither provided any details of any threat received by her, nor had she provided her mobile number or latest address to the Commissioner of Police. He further submitted that even otherwise, the respondents had not even received any further communication from the woman or her counsel in this regard.
