Justice Rajendra Kumar Verma of the Madhya Pradesh High Court has dismissed an anticipatory bail plea of an accused who allegedly made certain comments drawing similarities between the Rashtriya Swayamsevak Sangh (RSS) and the Taliban.
As per the prosecution's case, the applicant along with the co-accused had made certain comments alleging Rashtriya Swayam Sewak Sangh as the Taliban Terrorist Organization on social media and the message went viral. It is alleged that this created nuisance and instigated religious sentiments of the public.
On the other hand the accused person has contended that he has been falsely implicated in the case due to political rivalry.
He stated that he has never made comments on any religion or any organization. Further that there is no direct or indirect evidence against the applicant, and that he has been made an accused only on the basis of suspicions. He has also contended that the investigation has been completed but the chargesheet has not been filed. He said that as the trial will take a long time due to Covid-19, hence he ought to be granted anticipatory bail.
However, the Court refused to grant such bail stating that:
"Keeping in view the facts and circumstances of the case and on perusal of the material available on record including case diary and the role attributed in the commission of offences by the applicant, there is sufficient evidence available against the applicant, in the opinion of this Court, this Court is not inclined to grant the benefit of anticipatory bail to the applicant."
