The Bombay High Court yesterday granted bail to Gautam Thapar in the case pertaining to alleged sale of a property situated at Amrita Shergill Marg, New Delhi to a company owned by Bindu Kapoor, wife of former YES Bank Chairman Rana Kapoor.
An FIR had been registered by the Central Bureau of Investigation (CBI) in Mumbai in this regard last year. The Trial Court at Bombay had rejected the first bail application of Thapar earlier in December 2021.
Mahesh Jethmalani, Senior Advocate appearing for Thapar submitted that after registration of the FIR, Thapar has joined investigation as and when called upon by the investigating agency. Further, it was argued that the chargesheet has been filed in the present case in October 2021 and summons were issued pursuant to which Thapar entered appearance before the Ld. Trial Court through Counsel. However, Mr. Thapar was not arrested by CBI throughout the investigation even before the chargesheet was filed and summons were issued by the Ld. Trial Court.
It was further submitted that the present case is squarely covered under the guidelines issued by the Supreme Court in a judgment in Satender Kumar Antil v. CBI & Anr
Thapar’s bail pleas was opposed by Hiten Venegaonkar, the Public Prosecutor appearing for CBI.
The court on hearing submissions of the parties granted bail to Thapar in both the CBI & E.D. Bombay matters pertaining to the sale of property located at 40, Amrita Shergill Marg, Delhi.
Jethmalani appearing was briefed by a team of Karanjawala & Co. led by Sandeep Kapur, Senior Partner and comprising of Vivek Suri, Abhimanshu Dhyani and Ravi Sharma, Advocates.
