The Allahabad High Court recently rejected the bail plea of a man, a Nepali Citizen, allegedly from whose possession three fake Aadhaar Cards were recovered. It was also alleged that the man was in regular touch with Pakistan nationals through multiple mobile numbers.
The bench of Justice Krishan Pahal passed the order on the bail application filed by one Mohd. Saleem Khan who was booked under Sections 419, 420, 467, 468, 469, 471 of the Indian Penal Code.
As per the prosecution story, Khan was arrested on February 28, 2021 and from his possession, three fake Aadhaar cards in his name but having different dates of birth, a Passport of Nepal, and other documents were recovered. Khan was also found to have been taking up whatsapp chat with Pakistan nationals by using 11 mobile numbers.
However, Khan's counsel had stated that he was falsely implicated in the present case as he had not committed any offence by using the alleged documents.
Stressing that Khan had no criminal history, his counsel had asserted before the court that Khan had gone to Egypt to study where he had made some friends who are the Pakistan nationals and he used to chat with them and nothing incriminating was found in his chats with them.
On the other hand, vehemently opposing Khan's bail plea, the Additional Government Advocate had argued that if Khan had no malafide intention then why he was keeping three forged documents at a time.
He submitted that Khan had also prepared a fake ID in the name of Mohd. Salim Ajahari and had created an email id with a fake name too.
He further told the court that as per the CDR, Khan's location was never static rather he used to roam about at various places across the country.
Taking note of the submissions made, Court noted that Khan was not an Indian and the matter pertains to national security. Accordingly, Court rejected his bail application.
