The Allahabad High Court has granted interim anticipatory bail to Quavi Ahmed, former Samajwadi Party MLA Saeed Ahmad's son in a case registered against him for various offences including rape and attempt to convert forcefully by misrepresentation.
Granting the interim relief to Ahmad, the bench of Justice Saumitra Dayal Singh has fixed January 7, 2022 as the next date of hearing and has also directed the state government to file a counter-affidavit in the case.
In his bail application, Ahmad had contended that false allegations had been made against him to pressurize him as he and the alleged victim woman had business relations, which went sour with the passage of time, and only because of this reason false, frivolous and malicious allegations had been made.
On the contrary, the prosecution story states that the victim woman, owner of a gym and Miss India competition contender, came in contact with Ahmad in the year 2018, who had befriended her by changing his name.
The woman had alleged that one time Ahmad took her to Lucknow on the pretext of running a beauty parlor where he exploited her sexually. She had also alleged that Ahmad used to give her sedatives and had made obscene videos of her to blackmail her.
Also, as per the First Information Report (FIR), on September 12, 2021, Ahmad had attacked the alleged victim woman in the Civil Lines area of the Prayagraj city and chased her. The woman had stated that to save her life she had to run into a police post and after this incident only, she decided to file a case against Ahmad.
Consequently, on September 13, 2021, an FIR was registered against Ahmad under Sections -328, 376, 323, 504, 506, 392, 452, 120- B I.P.C. and Sections-3, 5(1) of Uttar Pradesh Prohibition of Unlawful Conversion of Religion Ordinance, 2020.
However, during the hearing of his bail plea, Ahmad had argued that inherently, improbable fact allegation had been made in the FIR and also there was a CCTV footage showing that on September 12, the alleged victim girl had parked her two-wheeler vehicle outside Ahmad's house and hired a three-wheeler rickshaw only to create the false narration.
Accordingly, considering the facts and circumstances of the case, the court opined that at this stage, Ahmad was entitled to interim anticipatory bail.
Court has, therefore, directed that in the event of Ahamad's arrest, he shall be released on interim anticipatory bail till the next date fixed, on his furnishing a personal bond of Rs. 50,000.
