The Allahabad High Court recently granted bail to a man booked under section 3 (prohibition of cow slaughter), section 5A (transportation of protected animals without permit) and section 8 of the Uttar Pradesh Prevention Of Cow Slaughter Act and other criminal provisions.
Before the bench of Justice Ram Krishna Gautam, accused Amarpal's counsel had alleged that Amarpal had been falsely accused in the case as there was no recovery of any offending material from his possession.
He had argued that in the instant matter, neither any slaughtering nor case of possession of beef, rather a case of transportation of cow slaughtering substances was there.
He had further averred that the alleged place of occurrence was also not a border State and no such recovery was made from Amarpal's possession which would render him liable for transportation of cows for slaughter.
Furthermore, he had also stressed that there was no independent public witness in the matter who would be able to confirm the allegations against Amarpal.
Therefore, pointing out that Amarpal was in jail since October 21, 2021, and had no criminal antecedent, his counsel had urged the court to release Amarpal on bail. He had also assured the court that there was no likelihood of Amarpal fleeing from course of justice or tampering with evidence in case of release on bail.
Noting that despite vehemently opposing Amarpal's bail, the Additional Government Advocate could not oppose these facts, court granted Amarpal bail on him executing a personal bond and two reliable sureties, each, in the like amount, to the satisfaction of the court concerned.
