Allahabad High Court grants bail to man accused in 200 Kg. beef, cow parts recovery case

The Allahabad High Court on Monday granted bail to a man accused in 200 Kilogram beef, cow parts recovery case. The bail applicant namely Sajid @Kale was not arrested from the recovery spot, however, the co-accused in the case had named him in his confessional statement.

The bench of Justice Mohd. Faiz Alam Khan granted Sajid bail taking into account the fact that co-accused Vaseem, from whom the flesh was actually recovered, has already been granted bail last month.

In November last year, Vaseem was arrested from a sugar cane field along with beef and some other body parts of the cow. Sajid was not arrested from the recovery spot but Vaseem had named him in his confessional statement. All the accused in the case were booked under Section 3/5/8 Cow Slaughter Act.

Pressing Sajid's bail plea, his counsel had alleged that Sajid has falsely been implicated in the instant case and he has not committed any offence as claimed by the prosecution nor he was arrested from the spot and nothing incriminating has been recovered from his possession or his pointing out.

He had submitted, "the name of the applicant (Sajid) has surfaced in the confessional statement of co-accused Vaseem who has been arrested with incriminating flesh....(who) has already been released on bail by a Coordinate Bench of this Court"

Additionally, he had further informed the Court that the other co-accused standing on the identical footing, namely, Mohd. Aasif has also been released on bail by a Coordinate Bench of the Court.

Pertaining to the counter argument raised by the Additional Government Advocate that Sajid is a habitual offender of the heinous offences, Sajid's Counsel had averred that the criminal history of 7 cases against Sajid had been adequately explained and in all those cases, he has been released on bail by the competent courts.

Therefore, keeping in view the nature of the offence, evidence, complicity of the accused, severity of punishment, submissions of counsels for both the parties, Court found Sajid's case fit for bail and directed him to be released on bail on furnishing a personal bond with two sureties in the like amount to the satisfaction of the court concerned.
