After being informed that a girl, who had performed inter-caste marriage, got abducted from her advocate's chamber on the day of the hearing of her case, the Allahabad High Court directed the Uttar Pradesh police to take action on priority basis and to produce the girl before the Court on the next date of listing.
The bench of Justice Umesh Kumar noted, "It is very surprising and unfortunate that in front of the High Court, miscreants abducted the girl from the chamber of the advocate forcefully....Petitioner no.2 (her husband) is at liberty to move appropriate application before appropriate authority for needful action."
The Court was dealing with the protection plea filed by the girl and her husband who had recently gotten married. The girl is a Brahmin and her husband belongs to the OBC community. The couple had moved the court fearing for their life and liberty at the hands of girl's family.
On April 8, on the allegations of girl's family that she had been forcefully abducted by her husband, Court had decided to hear the girl's version and had ordered her personal presence before the Court on April 20.
However, when the matter was taken up on April 20, girl and her husband's counsel alleged before the Court that in connivance with respondent no.4 (girl's family member) more than 20 miscreants surrounded his chambers and forcefully abducted the girl from his chamber.
Taking a serious view of the incident, Court asked the Police to take quick action and produce the girl before the Court. "The Senior Superintendent of Police, Prayagraj / Superintendent of Police, Jaunpur is directed to look into the matter on priority basis and produce the girl before the Court on the next date of listing," Court ordered.
Posting the matter on May 17, 2022 for further hearing, Court directed petitioners to remain present before the Court on that day.
