Madhya Pradesh High Court grants temporary bail to man to look-after pregnant wife

The Madhya Pradesh High Court recently allowed the bail application moved by a murder accused whose wife was pregnant and was due to deliver the child within a week. Court granted him bail for a period of 90 days taking note of the fact that his wife was alone and there was nobody in the family to look-after her.

Passing the order, the bench of Justice Sanjay Dwivedi noted that State had also been granted time to verify and ascertain the said facts and as per its report, the wife of the bail applicant was pregnant and was to be hospitalized.

Ravish Sood @Aman had moved a temporary bail application under Section 439 of CrPC in connection with a case registered for the offences punishable under Sections 302, 307, 294, 506, 147, 148, 149, 323, 324 and 34 of the Indian Penal Code. 

Sood's Counsel had moved the temporary bail for Sood on the ground that his wife was pregnant and date of delivery was expected in coming week. She had submitted that as per the advice of the doctor, Sood's wife had to be hospitalized on the date of the hearing itself and there was nobody to look-after her. 

She had further alleged that Sood's wife will have to undergo surgery and it will take some time for her to recover. Therefore, she had sought three months' temporary bail for Sood, who being the husband, had to fulfill his duty. 

On going through the existing facts and circumstances of the case, Court deemed it appropriate to consider Sood's bail plea and ordered that Sood shall be released on temporary bail for a period of 90 days upon his furnishing a personal bond in the sum of Rs.1,00,000.

However, Court imposed certain conditions which included that upon release, Sood shall not take undue advantage of or abuse the liberty and he shall maintain law and order and shall not indulge in any illegal act or offence.
