Allahabad High Court directs DM Chandauli to seek instruction from MEA in case involving infiltration by unauthorised foreigner

The Allahabad High Court recently directed the District Magistrate, Chandauli to file counter affidavit on the bail application moved by one Farookh Pramanik who had allegedly entered India without valid documents.

Passing the order, the bench of Justice Vivek Varma directed the District Magistrate to also take necessary instructions from the Ministry of External Affairs, Government of India.

Opposing, Pramanik's bail plea, the Additional Government Advocate Vikas Sahai had apprised the court that the matter relates to the infiltration of unauthorized foreign nationals in India. He informed the court that there is no valid documentation regarding permission having been granted to Pramanik, a foreign national, to enter the country. 

Therefore, the AGA had submitted that matters as the instant one have a bearing on national security. Taking note of AGA's submissions, Court directed the DM, Chandauli to file the counter and posted the matter on May 9, 2022 for further hearing. 

In related news, last year, a Public Interest Litigation seeking detection, deportation and detention of the Rohingyas was filed in the Supreme Court.

The PIL amongst other things sought the addition of a chapter in the Indian Penal code, making “illegal infiltration a cognizable non-bailable and non-compoundable offense”.

The petition while indicating a link between militant organizations and the issue of infiltration by militant organizations stated that the “dangerous consequences of large-scale infiltrations from Bangladesh-Myanmar for the nation as a whole, need to be emphatically stressed.”
